Food Service Establishment Permit: New York City restaurant guide
NYC DOHMH
What it is
The core operating permit for serving food to the public. You may begin operating 22 days after you submit the application even if you have not received the permit; to open sooner you need a pre-operating inspection.
When a restaurant needs it
Every fixed-location restaurant / food service establishment — including bars that serve only drinks.
How to apply
Apply online through NYC Online Licensing (nyc.gov/dohmhpermits) or in person at the DCWP Licensing Center, 42 Broadway, Manhattan.
Documents you’ll need
- Food Protection Certificate (or course registration)
- Sales Tax Certificate of Authority
- Workers' comp + disability certificates naming DOHMH
- Photo ID
- Power of Attorney / Authority to Act form (if an agent files)
- Valid email address
Good to know
The 22-day rule is confirmed on the official page; DOHMH then makes an unannounced inspection after you open. To open sooner, call 212-676-1600 to schedule a pre-operating inspection. Health Code Article 81 applies to bars, caterers and mobile units as well as restaurants — a bar with no kitchen and a delivery-only kitchen both need this permit.
