Tenant Habitability Plan (LAHD) — construction in a rent-stabilized building with tenants: Los Angeles restaurant guide
LA Housing Department
What it is
If your build-out is in a building with occupied rent-stabilized (RSO) apartments and involves replacing water, gas, drain or electrical lines, HVAC, structural work or hazardous-materials abatement, the property owner must file a Tenant Habitability Plan with LAHD before LADBS issues the permit, and may owe temporary relocation to tenants.
When a restaurant needs it
Construction in a mixed-use building with occupied RSO units.
How to apply
The owner prepares the plan with LAHD Tenant Habitability Program staff (hcidla.code.thp@lacity.org, (213) 482-7039) and submits it with the LADBS permit application; LADBS checks for LAHD clearance.
Documents you’ll need
- Tenant Habitability Plan
- Scope of work and schedule
- Tenant notices and mitigation (relocation) plan
Good to know
Work may not leave tenants in an untenantable unit outside 8 a.m.–5 p.m. Monday–Friday; make the landlord responsible for the THP in your lease work-letter.
