Board of Zoning Adjustment Special Exception or Variance: Washington, D.C. restaurant guide

DC Office of Zoning / BZA

What it is

Zoning relief when your restaurant doesn't fit the zone's rules. One example is the 25% cap on eating and drinking frontage in most NC zones.

When a restaurant needs it

Only if the Zoning Administrator finds the use, frontage cap or other standards aren't met by right.

How to apply

File the application in IZIS (account required); the case is noticed, the ANC weighs in, and the BZA holds a public hearing.

Documents you’ll need

Fee
Varies — see DCOZ fee schedule
Processing time
Several months from filing to decision (case-specific)
Renewal
Order runs with the property, subject to its conditions
Who files
Property owner or authorized applicant, usually through a land-use attorney.

Good to know

Get a land-use attorney's opinion before signing a lease if your site needs relief; a denial can kill the project.
