ABC License Transfer (buying a licensed restaurant): Washington, D.C. restaurant guide

ABCA / ABC Board

What it is

When you buy an existing restaurant that holds a liquor license, the license is transferred to you ('Transfer with Sale' on the application) rather than applied for new; the Board reviews the new owners, and any settlement agreement transfers with the license.

When a restaurant needs it

Taking over a restaurant that already has a Class C/R or D/R license and keeping its class.

How to apply

File the Alcohol License Application marked 'Transfer with Sale' (or 'Stock Transfer') with the purchase and sales agreement, Clean Hands for the new entity and each owner, personal history affidavits and police clearances.

Documents you’ll need

Fee
$75 application fee; the license fee for the class/capacity tier applies on renewal — see ABCA fee schedule
Processing time
Varies; placards are required only for new licenses and substantial changes, so a straight transfer is usually faster
Renewal
Follows the existing license cycle
Who files
Buyer (new licensee) or ABC attorney.

Good to know

Settlement agreements 'run for the term of the license' and bind the new owner, so read the seller's agreement before you sign. Changing hours, seats or adding entertainment is a 'substantial change' that triggers placards.
