Special Use (Zoning Board of Appeals): Chicago restaurant guide

Chicago Zoning Board of Appeals

What it is

When the zoning table lists your use as 'S' (special use), such as a tavern in B3 or a rooftop patio in B3/C districts, you need ZBA approval after a public hearing.

When a restaurant needs it

Only if your zoning check shows special use is required.

How to apply

File a hard-copy Special Use Application with the Proposed Findings of Fact and an Economic Disclosure Statement (EDS). The ZBA hears cases on the third Friday of each month at City Hall.

Documents you’ll need

Fee
Varies — see ZBA application
Processing time
Typically several months (monthly hearings)
Renewal
Runs with the approval conditions
Who files
The owner or a zoning attorney files and presents.

Good to know

An application is not filed until ZBA staff receive the hard copy, and witnesses must attend the hearing in person. Most applicants hire a zoning attorney.
