Sidewalk Café Permit: Chicago restaurant guide
Chicago BACP — Public Way Use
What it is
Permission to put tables and chairs on the public sidewalk next to your restaurant.
When a restaurant needs it
Outdoor seating on the public sidewalk.
How to apply
Apply in the City of Chicago Inspection, Permitting & Licensing portal with a measured site plan, sidewalk photos and insurance. BACP forwards the application to the ward alderman for introduction of a City Council ordinance approving it; the fee is due when the ordinance is introduced, and you print and display the permit and approved plan once it issues.
Documents you’ll need
- Valid Retail Food Establishment license (or Tavern license)
- Liquor license if serving alcohol
- Certificate of insurance and policy endorsement: general liability of at least $500,000 per occurrence / $1,000,000 aggregate
- Site plan (8.5" x 11") with dimensions and a 6-foot pedestrian path
- Photos of the sidewalk location
- Alderman's recommendation
- Proof of neighbor notification if the café extends in front of a neighboring property
Good to know
You need the food license first. Cafés may operate between 8 a.m. and midnight unless your permit says otherwise, alcohol needs dram shop insurance, and BYOB is prohibited.
