Zoning Board of Appeal (ZBA) Relief — Variance / Conditional Use: Boston restaurant guide

Boston Zoning Board of Appeal

What it is

If restaurant use (or takeout, a bar, or late live entertainment) is conditional or forbidden at your address, ISD refuses the long-form permit, and you appeal to the ZBA for relief at a public hearing.

When a restaurant needs it

Only when ISD issues a zoning refusal letter.

How to apply

File the appeal within 45 days of the refusal, online in the ISD portal or in person at 1010 Mass. Ave., 5th floor. Complete the community process (abutters and neighborhood group meetings) through your Office of Neighborhood Services liaison.

Documents you’ll need

Fee
$150 per violation ($150 flat for residential buildings of 3 units or fewer)
Processing time
Typically 3–6 months
Renewal
None
Who files
The owner or applicant files; most hire a zoning attorney to present at the hearing.

Good to know

Zoning relief granted to a previous tenant may carry 'provisos' that don't transfer to you. Read the old decision before you assume you're covered.
