Place of Assembly Permit: Boston restaurant guide

Boston Fire Department — Fire Prevention

What it is

Annual BFD permit for any venue where 50 or more people gather, restaurants included. Inspectors check egress, exits, fire systems, emergency lighting and furnishing flame certifications.

When a restaurant needs it

Occupant capacity of 50 or more (including permanent patios counted in capacity).

How to apply

Apply online through the Fire Prevention portal (or in person at 1010 Mass. Ave., 4th floor) after you have your Certificate of Occupancy and Certificate of Inspection.

Documents you’ll need

Fee
Annual fee from $160 (50–99 capacity) up to $6,500 (14,000+), based on occupant load
Processing time
A few days to a few weeks; the city's guide warns full approval can take 3+ months
Renewal
Annual; expires September 30
Who files
The owner/operator files; the egress plan must be prepared by a registered architect or engineer.

Good to know

Keep the approved furniture layout. Changing it or going over capacity is a violation, and the Licensing Board needs a valid permit before releasing a CV or liquor license for 50+ capacity.
