Outdoor Dining Program Permit (seasonal patio): Boston restaurant guide

Boston Office of Small Business / Licensing Board (multi-agency review)

What it is

Lets you add a seasonal patio on the sidewalk, in parking spaces or on private property from May 1 to October 31. A permanent patio is a separate, multi-agency approval that must appear on your CO, Inspection Certificate and licenses.

When a restaurant needs it

Any outdoor seating.

How to apply

Apply through the Outdoor Dining Program online application (applications typically open in February) after reading that year's program guidelines.

Documents you’ll need

Fee
Public property patios: $199/month (CV only) or $399/month (with alcohol license); private property: no charge
Processing time
2–4 weeks for new applicants; 1–3 weeks for returning applicants
Renewal
Re-apply each season
Who files
The licensed restaurant operator applies.

Good to know

Most North End restaurants are excluded because of narrow streets and sidewalks, and any unpaid fees from past years make you ineligible.
